Fed: Commonwealth Bank in court over forcing staff resignations
SYDNEY, April 15 AAP - The Commonwealth Bank of Australia (CBA) is being taken to theFederal Court over allegations it is forcing employees to resign and reapply for jobswith its subsidiary CommSec.
Finance Sector Union (FSU) assistant secretary Sharron Caddie said the union wouldseek a court order to prevent the practice.
By resigning and re-applying for jobs with CommSec, CBA employees would have to movefrom a collective enterprise employment agreement and on to individually negotiated contracts,she said.
"CBA is trying to coerce employees on to substandard conditions by making offers ofa job in its premium financial services division conditional on resigning their currentpositions," Ms Caddie said in a statement.
"They would then be offered inferior individual agreements by CommSec."
Industrial lawyer Anne Gooley will ask the Federal Court tomorrow to declare that CBAengaged in misleading and deceptive conduct under the Trade Practices Act, by failingto disclose its intention to discontinue employment of the workers.
At least one CBA employee intended to testify under a pseudonym, Ms Gooley said.
The hearing is scheduled for the Federal Court in Melbourne tomorrow.
